V&A WATERFRONT COMPETITION TERMS AND CONDITIONS ENTRY AND PARTICIPATION RULES FOR THE UNLIMITED FESTIVE JOY COMPETITION GENERAL ENTRY CONDITIONS The Unlimited Festive Joy competition starts at 12pm midnight on the 5th of December 2022 and closes at 11:59pm on 30th of December 2022. The competition activations will be open at V&A Amphitheatre from the 15th of December 2022 at 12pm mid-day and closes at 11:59pm on 30th of December 2022. No late entries will be accepted. The competition is open to South African residents and international residents. Entrants must be over the age of 18 years. The following persons are excluded from this competition and may not participate – a director, member, partner, employee, or agent of, or consultant to V and A Waterfront Holdings (Pty) Ltd (“V&A“) and its subsidiaries or any other person who directly or indirectly controls or is controlled by V&A; and a supplier of goods or services in connection with this competition; and the spouses, life partners, business partners or immediate family members of the parties referred to in 1.4.1 and 1.4.2. V&A Waterfront’s tenants (excluding residential tenants either renting units or owning apartments at the V&A) and their staff. If you have won any V&A competition within the last 30 (thirty) calendar days, you may not participate in this competition. HOW TO ENTER To enter this competition, entrants are required to spend R250 or more at any one of the V&A’s restaurants, attractions, or retail shops, and by writing their name, and telephone number on the back of the till slip and placing it into an entry form box found at various visible common areas within the V&A Waterfront precinct. Only original receipts will be accepted as valid entries. You stand a chance of winning one of many prizes worth a grand overall total of R100 000.00 which includes SMEG appliances, a V&A voucher & daily prize giveaways. WINNER/S SELECTION Daily Giveaways The exciting daily crowd giveaways will be drawn by Scouts and announced by the MC daily at V&A Amphitheatre by 5pm between the 15th of December 2022 and 30 December 2022 using a random draw and lead by the MC. Several winners per day will be selected. The Customer Experience team will take a video and a picture of the draw. The winners will be required to sign a register to acknowledge that they have received their prize. Main Prize There will be only one (1) winner for the main prize (“the main prize winner”). The main prize winner will receive prizes worth R83 000 including SMEG appliances to the value of R63 000 (sixty three thousand rand) and a R20 000 (twenty thousand rand) V&A voucher. One (1) winner will be drawn from all the entry boxes on the 30th of December 2022, by 11pm. The draw will be broadcasted live on the V&A’s Facebook platform. We will ship SMEG appliances only in South Africa. If you reside outside of South Africa, it is your responsibility to ship the appliances at your own cost. We will provide storage for only 3 months at the V&A’s cost. The prize will be forfeited if not collect after 3 months. Smeg prizes will be delivered within South African borders only. If the winner resides outside of South Africa, delivery/shipment of prizes thereof will be entirely at the winner’s own cost. Proof of identity in a form of a South African ID document or passport will be required to collect prizes and the V&A Waterfront reserves the right to refuse handing over of a prize to any winner who refuses to or cannot provide sufficient documentation to the V&A’s satisfaction to verify his/her identity. You may be required to provide the V&A with additional information as it may be reasonably required to process and to facilitate your acceptance and/or use of a prize. The Winner agrees to the use of his/her name and image in any publicity material. Any personal data relating to the Winner, or any other entrants will be used solely in accordance with current Consumer Protection Act (CPA)/ the Protection of Personal Information Act (POPI) and will not be disclosed to a third party without the entrant’s prior consent. Entry into the Competition will be deemed as acceptance of these terms and conditions. This Competition is in no way sponsored, endorsed, or administered by, or associated with, Facebook, Twitter, or any other Social Network. The Participant, by part taking in the Competition consents to his/her personal information to be shared with the Promoter’s employees, contractors, or agents for the purpose of this Competition and for the purpose of sharing future promotions. PRIZES Main Prize The main prize worth R83 000 consists of the following: a V&A voucher worth R20 000 and, Select Smeg appliances worth R63 000 including 1 x Smeg FAB28 Retro Refrigerator; 1 x Smeg KLF03 Retro Electric Kettle; 1 x Smeg TSF01 Retro 2-Slice Toaster; 1 x Smeg DCF02 Retro Filter Coffee Machine; 1 x Smeg MFF01 Retro Milk Frother; 1 x Smeg CGF01 Retro Coffee Grinder; 1 x Smeg HMF01 Retro Hand Mixer and 1 x Smeg CJF01 Citrus Juicer. The winner may select Smeg appliances in any colour options available to Smeg South Africa. Colours are subject to stock availability in SA. If chosen colour is not available, the winner may opt to await shipping of product (approximately 8-14 weeks +) or provide an alternate colour option in order to facilitate prize claim. If the prize is not available despite Smeg’s reasonable endeavours to procure the prize, Smeg reserves the right to substitute prizes of equal value. The V&A does not provide any warranties and insurances for the prizes and if a product is found to be not in a good working order, the consumer will have to take this up with Smeg directly. Daily Crowd Prizes There will be a total of 15 daily giveaways prizes for the duration of this competition. Daily Prizes, which will be announced daily at V&A Amphitheatre, include but not limited to fashion vouchers, watch vouchers, coffee vouchers, wellness vouchers, stationery vouchers. It is your responsibility to provide accurate and truthful information on the entry form. If you are selected as the main prize winner but, despite reasonable efforts, and the V&A is unable to contact you based on the information that you provided on the entry form, within 7 (seven) days from the day the winners are drawn, then the V&A reserves the right not to award the main prize to you. A new winner will be drawn to receive the prize. You may not win a prize if it is unlawful for the V&A to supply such a prize to you. If you do win such a prize, you will forfeit it. All prizes are subject to sponsors’ conditions in terms of usage period and/or expiry dates. Conditions will be disclosed upon reception of prize. Failure to comply with these conditions could mean forfeiture of prize. All Winners will be required to provide their names, ID or passport numbers and contact details and to sign an acknowledgement of receipt of the Prize. You must obtain and possess, at your cost and expense, whatever documents and permissions that may be required to accept and use a prize, and which documents and permissions must remain valid in such minimum form and for such minimum period after the prize date as may be required by the relevant authorities. Reasonable arrangements will be made with the winners with regards to collection of the prizes. Once such arrangements are made and agreed on by both parties, then if the winner fails to collect their prize within 3 months, they will forfeit such prize. The prizes are non-transferable and cannot be exchanged or converted to cash. Where Participants/Winners consent to take part in the competition’s publicity campaigns, they will not be entitled to any remuneration for such participation and all materials arising from such participation will be the sole property of the V&A. GENERAL RULES AND INFORMATION You may obtain a copy of the competition rules from the V&A Website. By entering this Competition, you agree to be bound by these rules which will be interpreted by the V&A, whose decision regarding any dispute will be final and binding. In the event of unforeseen circumstances or causes beyond our reasonable control, the V&A reserves the right to amend, modify, change, postpone, suspend, or cancel this Competition and any prizes (which have not yet been subject to a draw), or any aspect thereof, without notice at any time, for any reason which the V&A Waterfront reasonably deems necessary. Such a decision shall be published on V&A Waterfront ‘s website: www.waterfront.co.za. It is your responsibility to check the Website from time to time for any such changes The V&A reserve the right to extend the duration of the Competition Period if the V&A has not received the minimum number of qualifying entries for the Competition Period. The winner selection is final, and no correspondence will be entered into. Income and other taxes, if any, are the sole responsibility of the winner. Each entrant agrees not to submit any entry that infringes any third-party intellectual property rights, or any other rights, including without limitation, copyright, trademark, patent, trade secret or confidentiality obligations, or otherwise violates applicable law. Any personal information (including, without limitation, your name, age, ID number, address, postal code, telephone number and/or e-mail address) that you submit on the entry form will be used solely in connection with this competition and will not be disclosed to any third party except for the purposes of the competition, where applicable, unless you agree otherwise, or unless disclosure is required by law or court order.
